Helen Auckland is operated by TMB Commerce LLC. We use Shopify to provide our online store, products and related services (the “Services”). This Privacy Policy explains how we collect, use, hold and disclose personal information when you visit our website, place an order, contact us or otherwise use the Services. TMB Commerce LLC manages data processing and advertising services for Helen Auckland.

If our Terms of Service and this policy differ on the handling of personal information, this policy applies to that subject. Please read it alongside our Terms of Service. We handle personal information in accordance with applicable law, including the New Zealand Privacy Act 2020 where it applies.

Marketing and your choices

We may share information with Shopify and the service providers that help us operate the store, including payment processors, technology and cloud providers, customer-support services, analytics providers, our suppliers, fulfilment partners and carriers. We may also disclose information with your direction or consent, within our corporate group, in connection with a business transfer, or where required or permitted by law.

Our suppliers and fulfilment partners may be outside New Zealand, including in China, because orders are shipped from our supplier there. We disclose only information needed for the relevant purpose, such as delivery details to fulfil an order.

Shopify and other websites

Shopify hosts our online store and processes information to provide its platform and related features. Some Shopify features may use information about interactions with our store and other merchants where enabled. Shopify may have its own responsibilities for its use of that information. Our website may link to independent websites or services. Their privacy practices are governed by their own notices. Please review them before providing personal information.

Information about children

Our store is not directed at children. We do not knowingly collect personal information from children for marketing purposes. If you are a parent or guardian and believe a child has provided information to us, please contact us so we can review and, where appropriate, remove it.

Security and retention

We take reasonable steps to protect personal information against loss, unauthorised access, use or disclosure. No online system is perfectly secure, so please avoid sending payment card numbers or other highly sensitive information through ordinary email. We keep personal information only for as long as reasonably needed to provide the Services, meet legal and accounting obligations, resolve disputes or protect legitimate interests, then delete or de-identify it where appropriate. If we do not make a requested correction, you may ask us to attach a statement of correction where the law provides for that. International handling of information

Information may be stored or processed outside New Zealand by Shopify, TMB Commerce LLC and service providers involved in operating the store and fulfilling orders. When we disclose personal information to an overseas organisation, we take steps required by the New Zealand Privacy Act 2020 to ensure appropriate safeguards or otherwise rely on a lawful basis for the disclosure. Where the law requires your express authorisation because comparable safeguards may not apply, we will ask for it after providing the required information.
